Facing an allegation of sexual assault or sexual violence is one of the most stressful experiences a person can endure in the New Zealand criminal justice system. These cases are unique because they often involve private interactions where the only evidence is the word of one person against another. We have seen how quickly a reputation can be damaged by a single report to the police, regardless of the eventual outcome in court. Our experience shows that the complexity of these cases requires a calm, strategic approach from the very first moment of contact.

We understand that when you are dealing with such serious matters, you need straightforward answers. The legal system moves slowly, and the stakes involve your freedom, your career, and your future. Whether the allegation involves indecent assault or a more serious charge of sexual violation, the path forward requires a deep understanding of both the law and the human dynamics at play. We treat every case with absolute discretion, ensuring that your side of the story is heard and that your rights are protected against unlawful police conduct or media intrusion. Sexual violence cases are among the most difficult for the Ministry of Justice to process because of the high level of attrition. Attrition is a term used to describe how cases drop out of the system as they move from a report to a conviction. In our experience, understanding these numbers helps an accused person grasp the seriousness of the situation while also recognising the high burden of proof the prosecution must meet.

, sexual assaults have the lowest likelihood of being reported to Police. Only about 8% of these incidents are reported, meaning 92% never enter the formal justice system. The attrition rate remains high even after a report is made. Ministry of Justice analysis suggests that if only 10% of victimisations are reported, then for every 100 sexual violence victimisations, only about three result in a perpetrator being charged, and only one results in a conviction. These figures highlight the systemic complexity and the difficulty the state faces in proving these charges beyond a reasonable doubt.

However, once a charge is laid, the situation changes. Between 2013/14 and 2022/23, 13,926 people were charged with sexual offences, and 7,517 were convicted. This represents a conviction rate of approximately 54%. For the specific charge of sexual violation, 6,197 people were charged and 2,649 were convicted, a rate of about 43%. These statistics show that while many cases do not reach court, those that do are prosecuted vigorously. This is why we emphasise that the

The legal landscape regarding privacy in sexual cases changed significantly with the introduction of new laws. Protecting the identity of those involved is a primary concern for the courts, but the rules differ for the complainant and the defendant. A complainant is the person making the allegation of sexual assault or sexual violence.

, all complainants in sexual offence cases now have their identity automatically suppressed. This remains in place unless a judge expressly rules otherwise. Furthermore, the courts can no longer grant permanent name suppression to a convicted offender without the victim’s consent. For someone facing allegations, this means the complainant’s name will be kept out of the public eye, while the defendant must often apply specifically for name suppression to protect their own reputation during the trial process.

We have seen how the lack of name suppression can devastate a person's life before they have even had their day in court. Managing media risk and safeguarding your privacy is a core part of our role. We work to ensure that the principle of the presumption of innocence is upheld, even when the law provides significant automatic protections to the other party. The goal is to ensure a fair trial where the focus remains on the evidence rather than public opinion or gossip.

The moment the New Zealand Police contact you regarding an allegation of sexual offending, your defence begins. It is common for people to feel that they should explain their side immediately to "clear things up." However, we advise that you exercise your right to silence until you have spoken with a lawyer. This is a fundamental right, not an admission of guilt. We have seen cases where well-intentioned statements made at the police station were later used by the prosecution to highlight minor inconsistencies, which can be damaging in a trial.

The police process involves several stages, including the initial interview, the collection of forensic evidence, and the formal laying of charges. During an investigation into sexual assault cases, the police may look for physical evidence, digital communications, or witness statements. In some instances, they may seek a "sexual assault kit" or DNA testing if the allegation is recent. They will also look into the health and well-being of the complainant, which may include medical records or evidence of posttraumatic stress disorder and depression and anxiety. These factors are often used to support the complainant’s account, but they must be carefully scrutinised by your defence team.

Building a defence against sexual assault allegations

A successful defence in sexual cases often relies on a meticulous analysis of the evidence and the context of the relationship. Many cases involve an intimate partner or someone known to the accused, where the central issue is consent. The law in New Zealand defines consent as a person's conscious and voluntary agreement to the sexual activity. If there is a reasonable doubt about whether consent was given, or whether the accused believed on reasonable grounds that consent was given, the prosecution cannot secure a conviction.

In our experience, we often focus on the following themes when building a defence:

Challenging the sufficiency of the evidence is the first step. We look for gaps in the police case and inconsistencies in the complainant's story. We also examine potential motivations for false allegations, which can sometimes arise from interpersonal violence or complicated relationship breakdowns. Scrutinising the reliability of memory and the impact of time on the reporting of an offence is also critical, as many sexual violence cases are reported months or even years after the alleged event.

We also address the issue of "rape myth acceptance" in jury trials. This involves the subconscious biases that people may hold about how a victim of sexual assault "should" behave. The court provides specific directions to juries to ensure they do not rely on these myths, but a skilled advocate must also be prepared to challenge any unfair assumptions that could prejudice the defendant. We use expert witnesses where appropriate to explain the complexities of human behaviour and the forensic realities of the case.

The penalties for these crimes are severe. Sexual violation and rape carry a maximum penalty of 20 years’ imprisonment. Indecent assault carries up to 7 years. In cases involving children, there is also the risk of being placed on the child sex offender register. Given these stakes, we treat every piece of evidence as a vital component of your future. During this time, there will be multiple court appearances, including the first appearance, bail hearings, and pre-trial applications. We manage these procedural steps so you can focus on maintaining your life as much as possible. We also assist with applications for name suppression and variations to bail conditions, such as allowing you to continue working or travelling for essential purposes. Our role is to provide steady, professional support throughout the entire process, from the first police contact to the final decision in the District Court, High Court, or even the Court of Appeal.

We also understand the impact on your family and support services. Facing an allegation of violence against women or any form of sexual harassment can lead to social isolation. We encourage our clients to seek help and support from a crisis support service or a national sexual violence resource if they are struggling with the emotional weight of the proceedings. Having a strong legal team is essential, but having a personal support network is equally important for your long-term coping strategies.

If you have been accused of an offence such as attempted rape, unwanted sexual contact, or any form of sexual victimisation, the most important thing you can do is act quickly. The earlier we are involved, the more we can do to protect your rights and influence the direction of the police case. We have seen many instances where early legal intervention led to police decisions not to proceed with charges or to the withdrawal of charges before a trial.

Immediate legal advice protects your right to silence and prevents accidental self-incrimination during police questioning.

Experienced lawyers scrutinise every piece of evidence to identify procedural errors or breaches of the New Zealand Bill of Rights Act.

Strategic advocacy can lead to charges being dropped, reduced, or resolved through diversion and discharge without conviction.

Professional representation at sentencing focuses on rehabilitation and minimising the impact on your ability to work and travel.

Facing a criminal charge is a high-stakes situation that demands immediate, expert intervention. Whether you are dealing with a minor traffic matter or a serious High Court indictment, the decisions you make in the first few hours of police contact often dictate the final outcome of your case. A criminal conviction carries consequences that reach far beyond a courtroom, affecting your employment, your ability to travel overseas, and your standing in the community.

          Your Rights During Police Contact

The New Zealand Bill of Rights Act provides fundamental protections for anyone arrested or detained. You have the right to remain silent, the right to be told why you are being detained, and the right to consult a lawyer without delay. Anything you say to the police can be used as evidence against you, which makes early legal advice a necessity rather than an option.

Police officers may suggest that "telling your side of the story" will help resolve the matter quickly. In reality, providing a statement without legal guidance often limits your future defence options. We ensure the police caution is properly understood and advise you on whether to answer questions or consent to searches. If the police fail to respect these rights, we have grounds to challenge the admissibility of their evidence in court.

, we often look deeper into forensic data, CCTV footage, and medical reports. Identifying a breach of the right to counsel or an unlawful search can lead to the exclusion of key evidence, which sometimes results in the total dismissal of charges. Our focus remains on the prosecution's burden to prove their case beyond a reasonable doubt.

The legal process allows for negotiation with prosecutors before a case reaches trial. We analyse the strength of the Crown's case and engage in discussions to have charges reduced or amended to less serious offences. For first-time or lower-level offending, we explore diversion programmes that allow you to take responsibility without receiving a permanent criminal record.

The New Zealand criminal process follows a structured timeline that can last from a few months to over two years. The District Court handles the vast majority of these matters, with over 132,000 new criminal cases filed annually. We manage every stage of this journey, from your first appearance and bail application to pre-trial hearings and the trial itself.

If your case proceeds to a trial, we provide robust courtroom advocacy. This involves cross-examining witnesses, calling expert evidence, and presenting a clear narrative to the judge or jury. Whether you are facing a judge-alone trial for a traffic matter or a jury trial in the High Court for a complex drug or fraud case, our objective is to challenge the prosecution's version of events at every turn.

If a case results in a guilty plea or a conviction, the focus shifts to sentencing advocacy. This is a vital stage where we argue for the least restrictive outcome possible. We gather character references, cultural reports, and evidence of rehabilitation to ensure the judge sees the person behind the charge, not just the offence itself.

We advocate for community-based sentences or home detention as alternatives to imprisonment. For driving offences, we work to secure limited licences that allow you to continue working and supporting your family. Our role is to ensure that any penalty imposed is fair and takes into account your specific circumstances and potential for reform.

Facing a fraud investigation feels like being caught in a storm of paperwork and accusations. The weight of the Crown, with its vast resources and specialist investigators, can be overwhelming. In our experience, the most effective way to manage this pressure is to understand that a fraud case is a battle over evidence and interpretation. It is rarely a simple story of right and wrong. Instead, it is a contest over complex ledgers, digital footprints, and the specific intent behind financial transactions.

New Zealand maintains a reputation for low corruption, yet the agencies tasked with policing financial crime are more active than ever. The Serious Fraud Office (SFO), which is the lead agency for investigating serious or complex financial crime, has recently updated its focus to target emerging risks. While the number of complaints is rising, the actual number of cases that reach a courtroom remains small. This selectivity means that if you are facing a prosecution, the Crown has likely invested significant time and resources into building their case. We focus on dismantling that case by scrutinising every piece of evidence they intend to use against you.

What Evidence is Needed to Prove Fraud?

The Crown must prove several elements beyond a reasonable doubt to secure a fraud conviction. At its core, fraud is a dishonest activity that causes a financial loss. The prosecution must show that there was an intention to deceive at the time of the incident. Without this specific intent, a case may simply be a matter of poor business judgment or a civil dispute rather than a criminal offence.

Evidence of fraud typically falls into three categories: documentary evidence, digital material, and witness testimony. Documentary evidence includes bank statements, invoices, and contracts. Digital material covers emails, text messages, and metadata from devices like laptops and phones. Witness testimony often involves employees, business partners, or experts who can speak to the transactions in question. We have seen cases where a single email, taken out of context, is used by the Crown to infer a dishonest motive. Our job is to provide the context that disproves that inference.

The interpretation of these documents is where many cases are won or lost. The Crown might look at a series of complex transactions and see a deliberate attempt to hide funds. We work with forensic accounting specialists to show that those same transactions were legitimate business moves or the result of accounting errors. By providing an alternative, lawful explanation for the financial trail, we can create the reasonable doubt necessary for an acquittal.

There is a particular emphasis on frauds perpetrated by trusted professionals or professional enablers. If you are a director, manager, or contractor, you may find yourself under increased scrutiny because of your position of trust.

Public sector fraud is another major priority. Estimates suggest that up to $12.97 billion, or about 5% of government funds, is lost to fraud and error annually in New Zealand. This massive figure puts immense political pressure on agencies to make examples of those they investigate. Whether it involves procurement processes, wage subsidies, or emergency recovery funds, the Crown is looking for cases that create a deterrent effect. We understand this pressure and work to ensure that our clients are treated fairly, rather than being used as a statistic in a government crackdown.

This notice must be in writing. You must be given a reasonable opportunity to arrange for a lawyer to accompany you to the attendance. This is an exception to the right to silence. It is a criminal offence under section 45 to refuse or fail without lawful justification or excuse to do so. The maximum penalty on conviction in the case of an individual is imprisonment for a term not exceeding 12 months or a fine not exceeding $15,00 or in the case of a corporation a fine not exceeding $40,000.

Search warrants are another common tool in fraud investigations. Investigators may seek to obtain laptops, phones, and physical documents from your home or office. However, they require a warrant to do so, and that warrant must be based on sufficient evidence of fraudulent activity. We can review the validity of these warrants and challenge the admissibility of any evidence that was unlawfully obtained. If the Police exceeded their authority or the warrant was based on false information, we can apply to have that evidence excluded from the trial.

Defending a serious fraud case is a significant undertaking. It often requires hundreds of hours of document review, legal research, and expert consultation. Costs can vary depending on the complexity of the ledgers and the number of charges involved. However, financial constraints should not prevent you from receiving a high-quality defence. We have Ministry of Justice approval to act in Criminal Legal Aid PAL 1 to 4 proceedings. This means we can represent clients on any criminal charge, including serious fraud that carries the potential for significant prison time.

Whether you are self-funding your defence or applying for legal aid, we provide clear guidance on the likely costs and the steps involved. Our goal is to provide a steady, professional defence that focuses on the facts. We have helped many clients avoid jail time and minimise financial loss by identifying inconsistencies in the prosecution's case and challenging the credibility of their witnesses. We believe that every defendant deserves a fair trial where the burden of proof remains firmly on the Crown.

In a fraud case, the prosecution often tries to paint a picture of a lavish lifestyle funded by dishonest means. They may point to specific transactions or a "dishonest conduct" to persuade a jury of your guilt. We counter this by focusing on the authenticity of the documents and the truthfulness of the testimony. We look for the "why" behind the actions. Was there a genuine belief that the representation was true? Was there a lack of intent to deceive? These are the questions that can turn a case in your favour.

The cumulative effect of small inconsistencies can be powerful. If we can show that the Crown's investigator missed key documents or that a witness has a motive to lie, the entire prosecution case begins to weaken. We use our analytical skills to unpack the Crown's "story" and replace it with a factual account of what actually happened. This requires a deep understanding of both the law and the practicalities of business and accounting. You can

Convictions in New Zealand are subject to legal review and potential correction through the appellate process. For many people, a trial outcome or a sentencing decision feels like a finality that cannot be challenged, yet the law provides specific pathways to address errors. Appealing a conviction or sentence stands as a standard procedural right within the justice system. In our experience, the success of an appeal often rests on the ability to pinpoint technical legal mistakes that occurred during the original proceeding.

An appellate barrister performs a very different role than a trial lawyer. While a trial focuses on evidence and witnesses, an appeal focuses on the law and the record of what happened in the lower court. As a

, we review every transcript, judge’s ruling, and piece of evidence from the original trial. We look for instances where the law was applied incorrectly, where a judge may have misdirected a jury, or where evidence was admitted that should have been excluded.

Our work involves identifying a miscarriage of justice, which is the primary ground for challenging a conviction. This might involve fresh evidence that was not available at the time of the trial or a fundamental error in procedure that made the trial unfair. Whether the case involves a drug offence, a violent crime, or a complex fraud, the goal remains the same: to ensure the result is legally sound. We provide expert legal representation, clear advice, and strong advocacy throughout this demanding process.

The journey of an appeal typically begins in the High Court for District Court matters, or directly to the Court of Appeal for District Court jury trial appeals and High Court trials. In some rare and significant cases, the Supreme Court may grant leave to hear a final appeal. Each level of court has its own set of rules and expectations for written submissions and oral advocacy. We have seen that the most effective appeals are those that present a clear, concise argument regarding a specific legal error rather than simply trying to re-argue the entire trial.

Missing these deadlines can make the process significantly more difficult, as you would then need to apply for an extension of time. The court only grants these extensions if it is in the interests of justice and there is a valid reason for the delay.

Appeals generally fall into two categories: appeals against conviction and appeals against sentence. An appeal against conviction argues that the finding of guilt was wrong due to a legal error or a miscarriage of justice. An appeal against sentence argues that the penalty imposed was manifestly excessive or that the judge made an error in the sentencing principles applied.

The cost of an appeal can vary depending on the complexity of the trial and the volume of transcripts that need to be reviewed. For those who cannot afford private representation, criminal Legal Aid is often available for the appellate stage. We can assist with the application process to ensure you have the representation required to challenge a decision. Regarding your freedom during the process, bail pending an appeal is unusual and only granted in exceptional circumstances. In most cases, the sentence continues to be served while the appellate court considers the matter.

Being contacted by the Police or facing formal charges is an overwhelming experience that can leave you feeling uncertain about your future. In our experience, the most effective way to manage this stress is to treat knowledge as your first line of defence. Understanding the process and your rights allows you to make informed decisions rather than reacting out of fear. While

Your Fundamental Rights with Police in New Zealand

The moment Police begin questioning you is the moment your defence begins. Many people feel a natural urge to explain their side of the story immediately, but this can often complicate a case before it even reaches a courtroom. According to

, when Police are holding you for questioning, they must inform you of several critical rights. These include the right to remain silent and the right to talk to a lawyer in private and without any unreasonable delay. They must also warn you that anything you say will be recorded and can be given as evidence in court later on. We have seen cases where early statements made without legal advice became the primary hurdle in an otherwise strong defence. We recommend politely stating that you wish to exercise your right to silence until you have consulted with a criminal barrister. This is a standard legal protection, not an admission of guilt.

What Does a Criminal Defence Lawyer Do?

A criminal defence lawyer provides legal representation for individuals accused of a crime, focusing on protecting their rights and challenging the prosecution's evidence. The role involves guiding you through complex court processes and fighting for the best possible outcome. This might include getting charges dropped, negotiating lesser charges, or arguing for a discharge without conviction. At our Chambers, we operate on the fundamental principle that you are innocent until proven guilty. The burden lies entirely with the prosecution to prove their case beyond reasonable doubt before a judge or jury can convict. We assist from the moment of arrest, advising before Police questioning and scrutinising how evidence was obtained. If evidence was gathered unlawfully, we can challenge its admissibility, which often leads to the dismissal of charges. Our team has Ministry of Justice approval to act in Criminal Legal Aid PAL 1 to 4 proceedings, meaning we can represent clients facing any criminal offence, including those carrying a maximum penalty of life imprisonment.

The journey through the court system follows a specific hierarchy and set of procedures. A criminal case begins when Police or another authority formally accuse someone of breaking the law. If a defendant pleads not guilty, the case is adjourned to allow the judge or jury time to hear all the evidence. Most cases begin in the District Court. Less serious charges are typically heard by a judge alone, while more serious charges may involve jury trials. The most severe cases, such as murder or manslaughter, are handled in the High Court. Throughout this process, we handle everything from bail applications and sentencing indications to full trials and criminal appeals. Whether you are facing drug charges, fraud, or sexual offences, having a lawyer who understands the nuances of each court level is essential for a robust defence.

Traffic and Drink Driving Offences as Criminal Matters

Many New Zealanders are surprised to learn that a traffic offence resulting in a court summons is a criminal charge that can lead to a permanent conviction. We often see clients who view a driving matter as a minor administrative issue, only to find their employment or travel plans at risk. Whether it involves dangerous driving, driving while disqualified, or logbook offences, these charges require a dedicated

We specialise in applications for limited licences, also known as work licences, and can argue for community based sentences in place of disqualification under section 94 of the Land Transport Act. Drink driving offences are particularly strictly regulated. If Police fail to follow the prescribed testing procedures correctly, the charge may be dismissed. It is important to understand the different levels of offending. For drivers over 20, the criminal drink driving limit is 400mg/l of breath alcohol or 80mg/100ml of blood alcohol. However, an infringement band applies to readings between 251 to 400mg/l of breath or 50 to 80mg/100ml of blood. In these lower bands, a fixed infringement fine of $200 for breath or $700 for blood is issued, along with 50 demerit points, and no conviction is entered. For those facing higher readings or repeat offences, we provide

Every case is unique, and the strategy we employ depends on the specific circumstances of the offence and the client’s background. We have seen success in securing a discharge without conviction for clients where the consequences of a conviction would be out of all proportion to the gravity of the offence. This is a vital tool for protecting a person's career and ability to travel. We also assist with name suppression applications and proceeds of crime litigation. If you have been charged with a range of offences, from white-collar crime and organised crime to serious drug importation or homicide, the quality of your legal advice and representation will define your experience with the justice system. Costs for legal services can vary depending on the complexity of the case, but we are committed to providing clear guidance on all available funding options, including legal aid. If you require urgent legal advice, contacting an experienced criminal barrister as soon as possible is the most effective way to protect your rights and achieve a steady resolution.
